8. User-Generated Content and Feedback

Any information, feedback, testimonials, reviews, survey responses, suggestions, comments, ideas, or other content you submit to BuildTech Advisor ("User Content") becomes the exclusive property of BuildTech Advisor.

You grant BuildTech Advisor an irrevocable, perpetual, royalty-free, worldwide license to use, reproduce, modify, distribute, display, and create derivative works from any User Content without compensation, attribution, or further notice to you.

Arbitration Procedure:

• Each party shall bear its own costs and attorney's fees, unless the arbitrator awards such fees to the prevailing party.

• The arbitration award is final, binding, and enforceable in any court of competent jurisdiction.

• Either party may appeal only on grounds permitted by the Federal Arbitration Act.

Waiver of Jury Trial and Class Actions: To the maximum extent permitted by law, both you and BuildTech Advisor waive the right to a jury trial. You and BuildTech Advisor further agree that disputes shall be resolved on an individual basis only, not as part of any class action, class suit, collective proceeding, or representative action. If class action relief is requested, the entire dispute shall be deemed invalid, non-binding, and unenforceable.

15. Limitation on Claims

Any legal action or claim arising under or relating to these Terms, the Website, or the Services must be filed within one (1) year after the cause of action arises, or it shall be permanently barred, waived, and unenforceable.

16. Severability

If any provision of these Terms is found to be invalid, illegal, unenforceable, or in violation of law by a court of competent jurisdiction, that provision shall be severed and reformed to the minimum extent necessary to make it enforceable. These Terms are governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law principles.

Exclusive Jurisdiction: You irrevocably submit to the exclusive jurisdiction of the federal and state courts located in Clackamas County, Oregon for resolution of any disputes not subject to arbitration.

You waive any objection to venue or claim of inconvenient forum.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BuildTech Advisor regarding the Website and Services and supersede all prior communications, negotiations, and agreements.
